Divorced Spouse's Social Security Benefits


Is a Divorced Spouse Eligible to Receive Benefits?

There are a variety of family members who may be eligible to receive benefits, including a spouse and unmarried children under certain circumstances.

A divorced spouse is eligible for benefits if he or she is:

  • At least 62 years old;
  • Was married to the worker for at least 10 years;
  • Has been divorced from the worker for at least 2 years;
  • Has not remarried.

In addition, the worker must be eligible for retirement benefits (but does not actually have to be receiving benefits).
